Process of cheque which was already stopped for payment?

Dear sir/madam, i have saving account in bob, honey park road branch, surat. I had issued one non cts cheque for deposit in my husband's bank account, but after 15 days the cheque amount was not credited to benificaries account.. At last i requested to stop cheque payment in bob and same stop pay charges was debited from my account. But again bob had debited 342 rs. Charges from my account for reason of insufficient balance in account. I have submitted this written complaint application to my honey park road branch. But till after 3 days they have not resolved and reverse my cut ammount to my account.

At the outset, let me clarify that this site is designed by a group of Senior Banking Professionals to assist Bank Customers at large to provide guidance for resolution of any complain/query/grievance in respect of financial services. This site does not belong to any Bank or a regulator, which may please be noted.

If your cheque was stopped for payment, prior to the presentation in clearing, the bank is not in order in levying charges towards insufficiency of funds.  The cheque should have been returned with reason 'payment stopped'.  You need to be sure that your stop payment request precedes presentation of the cheque in clearing.  Your account statement would also clarify the dates, as to when the stop payment and cheque return charges were debited.  If the debit of Rs.342/- is subsequent to stopping your cheque, you should be demanding refund from the bank in writing.  Am sure, the bank would reverse the charges.  If it is not happening, you may go ahead and complain to senior management of the bank, whose contact / email details would be available on their website.

I wish you had stopped using non CTS cheques. Though non CTS cheques have not been phased out yet,  separate clearing system is followed  for clearing residual non CTS  2010 instruments, including post-dated and EMI cheques with effect from January 1, 2014. The frequency  of this clearing is different from CTS clearing. Hence delay in collection/crediting proceeds of non CTS cheques is inevitable.

In your case, it appears that though you  gave stop payment instruction for the cheque since the same was already presented and there was no funds in  your account, there is justification for the bank to have recovered both stop payment charges and also for return of cheque for reason of insufficient funds.

You can however follow up with your bank to use their discretion and waive cheque return charges. But you may succeed as a matter of right.
