Fraud of 47000/- from axis bank ATM?

Greetings of the day !! Further matter is that I tried to withdraw 47, 000 from  ATM on 3rd oct-2014.But I didn’t receive the amount & still this amount get deducted from my bank account.Then I contacted to bank & also lodged a police complaint.I am trying regularly to follow bank, but I am not getting any response from them. bank is telling me that your transaction was successful & we can’t return your amount & can’t do anything in this matter.This is mistake of bank & I have observed many draw backs from their side, i am stating these drawbacks (1) There was no security guard at the ATM during my transaction.Peoples were rushing there frequently. Acc to rule, security guard must be present there 24 hours.They have no answer of it.This is bank mistake. (2) I got only single message on my mobile that” your account is debited 47, 000/-” while there should be three messages of 20000, 20000 & 7000.Because Atm machine was clearly showing that u can’t withdraw more than 20000 in one time.according to rule, i should get three messages with three different transaction numbers, but I got only one message with one transaction no.They have no answer for it.This is bank mistake. (3) CCTV footage was of very bad quality, nothing was observed & no one was identified in footage, They are not providing clear & good quality footage.This is also bank mistake. (4) There was some mistake in ATM m/c.Its buttons were very hard to press. I am very much depressed from their response, having a hope from your side if you can help me.Its a humble request to you to do needful in this matter & help me to resolve the matter.

Dear Binno

There are inconsistencies in your statement.  While stating that you tried to withdraw Rs.47000/- from ATM on 3/10/2014, in the later part of the mail, you are mentioning that there should have been 3 messages of Rs.20,000/-, 20,000/- & 7,000/-, which was totally contradictory.  I also assume that you have gone through the complaint process of reporting the matter to Bank and then to Banking Ombudsman too, since the amount of Rs.47,000/- is quite substantial for anyone to loose.  

If you still feel that you lost the money due to the negligence of bank, only recourse is to approach Consumer Forum / Court of Law.

Hi Binno, since the transaction is almost a year old, first of all, you need to ensure that you have all the correspondence of complaint made earlier, along with the relevant documents.  You haven't confirmed, whether you made a complaint to Banking Ombudsman and if so, what has been the outcome.  If it is not done, you should be registering your complaint first with BO.  If it doesn't help, then you can contemplate to file a case in Consumer Forum with the help/assistance of an Advocate.

But sir if i don't want to go to  consumer forum did I have any other way to actually fight with the bank where i can directly file a complaint giants bank

Binno, you are only prolonging the issue.  Your recourse is firstly, the Bank itself (wherein you hold the account)and secondly Banking Ombudsman.  If you don't want to go for the third option of either consumer forum or court of law, then there is no other alternative, but to forget the matter.
